OVERVIEW
This website, MobiHub.ie, is operated by Mobilogist Limited, trading as Mobilogist and MobiHub.
Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Mobilogist Limited. These Terms explain the conditions that apply when you access our website, create an account or purchase products or services from us.
Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products and services to you.
By accessing our website or placing an order, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy and any other policies displayed on our website. If you do not agree with these Terms, you should not use our website or services.
Nothing in these Terms limits or removes any rights available to consumers under Irish or European Union law.

SECTION 2 – USE OF OUR WEBSITE
You may use our website only for lawful purposes.
When creating an account or placing an order, you must provide information that is accurate, current and complete. You are responsible for keeping your account credentials secure and for activity conducted through your account.
If you are under 18, you may use the website or purchase products only with the involvement and permission of a parent or legal guardian.
We may suspend or restrict access to the website where we reasonably believe that a user has breached these Terms, engaged in fraudulent activity or misused our services.
SECTION 3 – PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, specifications, photographs, colours, prices and availability are accurate.
The appearance or colour of a product may vary slightly depending on your screen, browser or device settings.
Refurbished products may show cosmetic signs of previous use. The applicable cosmetic condition, storage capacity, colour, battery information and included accessories will be stated on the relevant product page.
Product images may be used for illustration. The product title, description, selected variant and order confirmation determine the product included in your order.
We may update product descriptions, prices and availability or discontinue products without prior notice. Changes will not affect an order that we have already accepted, except where required to correct an obvious error or where agreed with you.
Nothing in this section removes your statutory rights where a product is faulty, damaged, unsafe or not as described.
SECTION 4 – ORDERS AND CONTRACT FORMATION
Placing an order is an offer to purchase products from us.
After you place an order, you will normally receive an acknowledgement email. This acknowledgement does not necessarily mean that your order has been accepted.
A contract is formed when we confirm that your order has been accepted or dispatched, whichever occurs first.
We may decline or cancel an order before acceptance where:
• A product is unavailable
• Payment cannot be authorised
• The order information is incomplete or incorrect
• We identify an obvious pricing or product-description error
• We reasonably suspect fraud, misuse or unauthorised resale
• We cannot deliver to the address provided
If we cancel an order after taking payment, we will refund the relevant amount to the original payment method.
Please check your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible. We cannot guarantee changes after an order has been processed or dispatched.
SECTION 5 – PRICES, VAT AND PAYMENT
Prices displayed on our website are in euro and include VAT where applicable, unless clearly stated otherwise.
Delivery charges and any other applicable costs will be displayed before you complete checkout.
We may change prices at any time, but changes will not affect orders that have already been accepted.
If a price is clearly incorrect because of an obvious error, we may contact you to offer the product at the correct price or cancel the order and issue a refund.
You must use a valid and authorised payment method. By submitting payment details, you confirm that you are authorised to use that payment method.
Payment processing may be provided by Shopify or another authorised payment provider. We do not receive or store your complete payment-card details.
SECTION 6 – DELIVERY
Available delivery methods, estimated delivery times and charges are displayed during checkout or in our Shipping Policy.
Delivery times are estimates unless we expressly agree to a guaranteed delivery date.
We are not responsible for delays caused by circumstances outside our reasonable control. If a significant delay occurs, we will provide the remedies required under applicable consumer law.
You are responsible for providing a complete and accurate delivery address. Additional delivery costs caused by an incorrect or incomplete address may be charged where permitted by law.
Where we arrange delivery, responsibility for loss of or damage to the goods generally passes to you when you, or a person nominated by you other than the carrier, takes physical possession of them.
Please contact us promptly if your order is missing, damaged in transit or marked as delivered but has not been received.
SECTION 7 – COLLECTION FROM A SHOP
Where collection is offered, we will notify you when your order is ready.
Please do not travel to collect an order until you have received confirmation that it is ready.
We may ask for the order confirmation and reasonable proof that the person collecting the order is authorised to do so.
Collection times and availability may vary between locations.
SECTION 8 – RETURNS, CANCELLATIONS AND REFUNDS
Returns, cancellations, exchanges and refunds are governed by our Return and Refund Policy, available through the footer of our website.
We provide a 30-day return policy for eligible online purchases. This is in addition to, and does not reduce, applicable statutory rights, including the European Union cooling-off rights available for most online purchases.
Certain exceptions may apply to change-of-mind returns, including personalised products, gift cards and sealed goods that are unsuitable for return for health or hygiene reasons once unsealed.
These exceptions do not remove your rights where goods are faulty, damaged or not as described.

SECTION 9 – WARRANTIES AND CONSUMER RIGHTS
Products sold by us are covered by the warranty stated on the applicable product page. Where a 12-month Mobilogist warranty is advertised, the warranty applies from the date of purchase and is subject to the warranty terms displayed on our website.
Our commercial warranty is provided in addition to your statutory rights and does not replace or limit them.
Products must conform to the sales contract and be of the quality, durability, functionality and description that consumers are reasonably entitled to expect under applicable law.
If a product is faulty or does not conform to the contract, you may be entitled to a repair, replacement, price reduction, cancellation or refund, depending on the circumstances and applicable consumer law.
Warranty coverage does not normally include accidental damage, liquid damage, misuse, unauthorised repairs, normal wear and tear or damage caused after delivery. These exclusions do not apply where the issue results from a fault that existed when the product was supplied or where excluding coverage would breach consumer law.
SECTION 10 – REFURBISHED PRODUCTS
Refurbished products are previously owned devices that have been inspected and tested before sale.
Cosmetic grading describes appearance only and does not change the requirement that the device must function as described.
Any material cosmetic marks, limitations, included accessories, storage capacity, colour, condition grade or battery-health commitment will be described on the product page where applicable.
Customers should review the selected condition, storage and colour options carefully before completing an order.
SECTION 11 – PROMOTIONS AND DISCOUNTS
Promotions, discount codes and special offers may be subject to separate conditions, expiry dates and availability.
Unless otherwise stated, discount codes cannot be exchanged for cash or combined with other promotions.
We may withdraw or correct a promotion where there has been an obvious error, misuse or fraud. This will not affect statutory consumer rights.
SECTION 12 – THIRD-PARTY SERVICES AND LINKS
Our website may include services, payment options, applications or links provided by third parties.
Third-party services may be governed by their own terms and privacy policies. We are not responsible for the content or operation of independent third-party websites.
Nothing in this section excludes responsibility that cannot legally be excluded.
SECTION 13 – RELATIONSHIP WITH SHOPIFY
Our online store is hosted by Shopify.
Purchases made through MobiHub.ie are transactions directly between you and Mobilogist Limited. Shopify provides the platform but is not the seller of the products purchased from our store.
Your use of certain Shopify services may also be subject to Shopify’s applicable terms and privacy notices.
SECTION 14 – PRIVACY
Our collection and use of personal information are explained in our Privacy Policy, available through the footer of our website.
We may share information with Shopify, payment providers, delivery companies and other service providers where necessary to operate the website, process orders, prevent fraud and provide our services.
Personal information will be handled in accordance with applicable data-protection law.
SECTION 15 – INTELLECTUAL PROPERTY
The website and its original content, branding, graphics, layout, text and other materials are owned by or licensed to Mobilogist Limited, except where ownership belongs to Shopify, product manufacturers or other third parties.
You may use the website for personal and lawful shopping purposes. You must not copy, reproduce, distribute, modify or commercially exploit our website content without permission, except where allowed by law.
Product names, manufacturer logos and trademarks belong to their respective owners.
SECTION 16 – REVIEWS AND USER CONTENT
If you submit a review, photograph, comment or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You grant us permission to display, reproduce and use submitted content for operating and promoting our business, subject to applicable law.
We may remove content that is unlawful, abusive, misleading, offensive, fraudulent or unrelated to the product or service being reviewed.
We will not prevent customers from submitting honest reviews or expressing genuine opinions.
SECTION 17 – PROHIBITED USES
You must not use our website:
• For unlawful, fraudulent or malicious purposes
• To infringe intellectual-property, privacy or other legal rights
• To submit false or misleading information
• To distribute viruses, malware, spam or harmful code
• To interfere with website security or operation
• To obtain unauthorised access to accounts or systems
• To scrape or extract website content in breach of applicable law or our rights
• To harass, abuse or harm another person
• To place fraudulent orders or misuse promotions
We may restrict access or cancel affected orders where misuse is reasonably suspected.
SECTION 18 – WEBSITE AVAILABILITY
We aim to keep our website available and accurate, but we cannot guarantee uninterrupted or error-free access.
We may temporarily suspend access for maintenance, security, updates or circumstances outside our reasonable control.
Information on the website is provided for general shopping purposes and should not be treated as professional, medical, financial or technical advice.
SECTION 19 – LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or a breach of mandatory consumer rights.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made primarily for commercial purposes.
We are not responsible for delays or failures caused by events outside our reasonable control, but this does not remove any remedy available to you under applicable consumer law.
SECTION 20 – ERRORS AND CORRECTIONS
We may correct typographical errors, inaccuracies or omissions relating to product information, availability, delivery or pricing.
If an error affects an order you have placed, we will contact you where reasonably possible and provide an appropriate option, which may include confirming the corrected information or cancelling the affected order for a refund.
SECTION 21 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent required.
The remaining provisions will continue to apply.
SECTION 22 – NO WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce it later.
SECTION 23 – GOVERNING LAW
These Terms and purchases made through MobiHub.ie are governed by the laws of Ireland.
The courts of Ireland will have jurisdiction, subject to any mandatory rights that allow a consumer to bring proceedings in another competent court.
If you are a consumer residing elsewhere in the European Union, you retain the mandatory consumer protections available under the laws applicable to you.
SECTION 24 – CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our services, business operations or legal obligations.
The current version will be published on this page with an updated date. Changes will not unfairly alter the terms of an order that has already been accepted.
